Attorney Thomas V. Attorney Murray has successfully settled and tried a wide array of divorces, modifications, trust / estate matters, and guardianship / conservatorship cases. He has also represented clients at the Client Security Board and in 2009 won $243,498 on behalf of a group of trust beneficiaries – the largest single award won that year. On many occasions he has been appointed to serve as a Guardian ad Litem by Probate and Family Court judges of Worcester, Suffolk and Middlesex Counties. Additionally, he serves as a court appointed conciliator for matters pending in the Worcester Probate and Family Court.

Our client, who was a legal resident from Brazil,  was stopped for speeding on Route 495 while traveling to work in his capacity as a constable. He had a valid LTC however he had a previous charge for Improper Storage of a Firearm that was dismissed. During the course of the roadside stop, the Trooper alleged that our client appeared nervous and was dressed in a manner similar to that of a police officer. Based upon these factors as well as the prior Improper Storage of a Firearm charge, the Trooper detained our client and began questioning him about firearms, his immigration status and what was inside the vehicle. The Trooper ordered our client to show his waistband, open up the center console and eventually had our client open up the glove compartment which contained a legally issued firearm. The Trooper alleged that the firearm was not in our client’s custody and control and not properly locked and stored. As such our client was charged with Improper Storage of a Firearm. Through the filing of a Motion to Suppress and after an evidentiary hearing in which the Trooper testified, the Court concluded that the Trooper did not have sufficient reasonable suspicion to detain our client beyond the scope of the original stop (speeding). The motion to suppress was allowed thus precluding the introduction of the firearm as well as the observations of the Trooper of the firearm inside the glove compartment. With no evidence to offer at trial, the Commonwealth dismissed the case.
Sex Crimes
Robbery
Lawsuit filed on behalf of estate of 23 year old who was murdered while inside his apartment after a botched robbery. Perpetrators arrested and charged criminally. Attorney Murray filed suit against the building owner for negligent security. Attorney Murray retained security expert who testified as to the failures of the building security system. Attorney Murray also subpoenaed two of the convicted perpetrators who testified as to the manner in which the break in occurred. The jury trial lasted 5 days before a verdict was reached.
Misdemeanors
Attorney Murray is a 1993 graduate of Fordham University and 1997 graduate of Western New England College School of Law. Upon obtaining his juris doctorate, Attorney Murray worked for five years in the Office of the District Attorney for the Middle District. He regularly prosecuted cases throughout the District Courts of Worcester County and also served as the supervisor of the Jury Session in the Worcester District Court. Attorney Murray represented the Commonwealth in both felony and misdemeanor matters, and was also assigned as a prosecutor in the Motor Vehicle Homicide Unit. Attorney Murray served as lead counsel for the Commonwealth in over 125 jury trials.

Assault
Client was employee of assisted living facility. Charged with assault and battery against family member of resident. Client testified and offered theory of self defense.
Client was charged with knowingly leaving the scene of a property damage accident after commercial truck driver reported his vehicle was struck at intersection. Evidence presented that client returned to scene shortly after accident occurred. After hearing before clerk magistrate, charge was dismissed.
In 2002, Attorney Murray joined the firm of Bernstein, Burwick & Tucker, LLP where the majority of his practice was focused on representing clients in personal injury cases and criminal defense. Attorney Murray also represented clients in business litigation, licensing matters and domestic relations cases.
