DUI/DWI
WHAT ARE THE DRIVER'S LICENSE PENALTIES FOR OUI/DUI/BREATHALYZER FAILURE/BREATH TEST REFUSAL? - The Law Offices of Kevin D. Quinlan
Traffic Violations
One example of why representation is helpful in traffic ticket appeals involves a citation for speeding. Many people are not aware that it is not enough for the police to prove that you drove over the posted speed limit. The issue is whether your speed was reasonable, given all of the factors at play, such as road conditions, visibility, amount of traffic, the condition of your vehicle, et cetera. Driving over the posted speed limit is merely one factor that the factfinder considers in determining if you were “speeding.”
Theft
Misdemeanors
If you have been charged with theft, any misdemeanor, DUI, OUI, drug charges, juvenile crime, domestic violence, assault and battery or anything requiring criminal defense in Massachusetts, call us. We can help.
Drug Crimes
Some other potential consequences include loss of license for many charges (including operating under the influence of alcohol, drug possession, and even “tagging” with spray paint), being placed on probation with conditions such as periodic reporting to your probation officer or drug and alcohol testing, receiving a suspended sentence, or being sent to a term of incarceration. Some charges have immigration consequences (and in this area something less than a guilty plea may still result in removal from the US), and a guilty finding on some charges would require that one register with the Sex Offender Registry Board.
Assault
In Commonwealth v. White (2024), the Massachusetts Appeals Court reversed a defendant’s conviction of the crime of assault and battery on a family or household
Juvenile Crimes
If you have been charged with theft, misdemeanors, DUI, OUI, drug charges, juvenile crime, domestic violence, assault and battery or anything requiring criminal defense in Massachusetts, call us. We can help.
Restraining Order
I have extensive experience handling criminal cases in the Superior Courts and District Courts of the Commonwealth, having resolved a great many of such cases. My track record includes dismissal of charges pre- and post-arraignment, acquittals after a bench trial or jury trial, charge concessions, alternative sentencing, and probation. I can often offer insight on the proclivities of the players in the procedural melee, such as the likelihood that a certain judge or prosecutor will agree with a request, or how receptive he or she may be to a proposal. Often, the best way to help a client accused of a crime is by obtaining a favorable disposition pretrial, but sometimes a trial is necessary. My trial skills have been honed by my large number of bench and jury trials, as well as by my handling of 209A and 258E restraining order hearings.
After graduating with honors from New England Law Boston in 2005, I began my practice at the firm Lane and Hamer, P.C., in Northbridge, Massachusetts, which was one of the firms at which I interned during law school. My focus at Lane and Hamer was primarily land use law, such as variances and special permits, boundary disputes, and construction issues. My time was generally spent drafting legal memoranda and appellate briefs, although I did take several cases to trial during this period.
Personal injury cases generally involve a claim that one party’s negligence caused injury to another party. Negligence is defined as failing to act as a reasonably prudent person would act. This could mean failing to drive in a reasonable manner causing injury, failing to maintain premises in a reasonably safe condition leading to injury, or other failures to exercise care.
