As a licensed member of the Washington Association of Criminal Defense Lawyers (WACDL) and the National Association of Criminal Defense Lawyers (NACDL), our firm handles cases in the state and federal courts of Washington, Oregon and Idaho.
DUI/DWI
When your future and your freedom are at risk, protecting your rights is deeply important. Whether you have been arrested for DUI or you face federal white collar criminal charges, an experienced and aggressive criminal attorney is in your best interest. At the Spokane Law Offices of Christian J. Phelps, we protect the accused in the state and federal courts of Washington, Oregon and Idaho.
Traffic Violations
You do not even have to be the at-fault driver to face felony vehicular assault or vehicular homicide charges. If you were impaired, the state can claim that your consumption of alcohol was the proximate cause of the car accident. Any prior alcohol or reckless driving convictions can result in penalty enhancements that can translate into additional jail time or prison time.
Sex Crimes
The Internet has provided a new avenue for state and federal governments to prosecute sex crimes. Even if you accidentally happened upon a child pornography site on the Internet or unintentionally viewed an improper image on your computer screen, you could be charged with possession of child pornography, even if you immediately deleted the image. If you arrange to meet someone who portrays him- or herself as a minor in a chat room or instant-message conversation, you could be charged with solicitation of a minor or attempted child rape.
Fraud
I represent people charged with all types of white-collar crimes, including Internet fraud, wire fraud, mail fraud, identity theft, embezzlement, insurance fraud, fraudulent claims, tax fraud and gambling fraud. I can help you regardless of whether you are facing state or federal charges.
Robbery
For example, if a former felon steals a six-pack of beer and pushes the store clerk who tries to stop him, what seems like shoplifting will be charged as a robbery, a strike offense, because the accused individual used "force" while committing theft. Is this worth life in prison? We will work with the state to try and change or lower the charge to a non-strike offense, thereby avoiding a life sentence.
Burglary
Burglary in Washington has nothing to do with stealing. Rather, it is unlawfully entering or remaining in a place with the intent to commit a crime while inside. Therefore, if you steal something after entering, it is considered both burglary and theft. Likewise, if you harm a person after entering, it is considered both first-degree burglary and assault.
White Collar Crimes
Many businesspeople and professionals face white-collar crime charges for activities they didn't even know were illegal. If you have been arrested for a white-collar crime, you need an experienced attorney on your side.
Theft
Misdemeanors
There are four degrees of assault in Washington state, and all are primarily based on differing levels of injury to the victim. If no significant injury is caused to the other person, it will be charged as fourth-degree assault, a gross misdemeanor. If the assault results in physical injury and requires medical care, it is known as aggravated or felony assault.
Embezzlement
Drug Crimes
Facing drug charges in the state courts of Washington, Oregon or Idaho is tough enough, but if you are facing federal drug charges, the stakes are even higher and the legal challenges far greater. You need a lawyer who has handled multiple federal trials and who can protect your future and your freedom. At the Spokane Law Offices of Christian J. Phelps, we handle federal drug charge cases in all of the federal districts in Washington, Oregon and Idaho. In special cases, we will travel to other federal districts.
Assault
Assault charges are taken very seriously in Washington state. In addition to significant jail time, an assault conviction can adversely affect your ability to find work, your cost for insurance and home mortgages, or even your civil rights.
Murder
Our firm is led by attorney Christian J. Phelps, who has dedicated his entire legal career to defending those charged with criminal offenses in the state and federal courts of Washington, Oregon and Idaho. As the former lead felony lawyer at John Cooney and Associates, P.S., he is an aggressive attorney with the experience needed to handle a diverse range of cases, from petty theft to first-degree murder.
Juvenile Crimes
We also protect the rights of minors charged as adults. If possible, we will fight to reduce the charges to juvenile crime charges. If a reduction is not possible, we know how to handle the rigors of the criminal courts of Washington, Oregon and Idaho.
Identity Theft
Identity theft is a very serious crime that often results in charges in federal court. While most identity theft charges involve the purchase of goods or property with the use of someone else's identity or financial information, ID theft can take many different forms. At the Spokane Law Offices of Christian J. Phelps, we protect the rights of those facing a variety of theft charges in the state and federal courts of Washington, Oregon and Idaho.
Homicide
In Washington, if you run a stop sign or traffic signal and injure someone in a car accident, it is likely that you will only face a charge of running a stop sign. However, if you are suspected of being intoxicated at the time of the crash, you might face a charge of vehicular assault. If the person you hit dies, you could be charged with vehicular homicide.
Shoplifting
Theft and shoplifting are often considered minor crimes. However, any criminal conviction can result in a lifelong criminal record. It is therefore extremely important to treat these cases seriously and protect your future. At the Spokane Law Offices of Christian J. Phelps, we protect the rights of those facing a variety of theft and robbery charges in the state and federal courts of Washington, Oregon and Idaho.
Restraining Order
Anyone, regardless of their criminal history, can be hit with a protection order or no-contact order. However, if you are convicted of violating your PO or NCO, the conviction will go on your permanent criminal record. At the Spokane Law Offices of Christian J. Phelps, we protect the rights of people accused of restraining order violations. We understand you have your own side of the story, and we will help you tell it to the proper authorities without risking further incrimination.
Forgery
White-Collar Crimes: Our firm handles a wide range of state and federal white collar crime cases, including those involving ID theft, theft, forgery and fraud.
Kidnapping
Manslaughter
Murder, Homicide, Manslaughter: Challenging the prosecution every step of the way, we will be ready to protect your rights and take your case to trial.
Internet Crimes
There are defenses against Internet sex crime charges. In a child porn case, I can challenge the search and seizure of your computer. If the police did not obtain a proper search warrant, any images obtained from your computer can be suppressed. We can also challenge forensic evidence obtained from your computer by hiring experts of our own to determine if you actually opened the files or transmitted the pictures. If you were arrested based on a sting operation (like those commonly portrayed on Dateline and other news programs) or in a chat room or an on-line forum, entrapment is a common and effective defense.
If you buy somebody's home when they are about to lose it due to foreclosure, and then you rent it back to them, you could be charged with a white-collar crime. When you use the equity in someone's home to take unfair advantage of them, the government calls it equity-skimming, also known as foreclosure rescue and foreclosure reconveyance. You might think you are engaged in a legitimate business of speculating in real estate, but the government can call your activities fraudulent or deceptive and charge you with a crime.
