Divorce
Collaborative Divorce: A couple were getting divorced; they needed to change their relationship from spouses to co-parents for the benefit of their two young children, one with special needs.
Child Support
Acquisition of Enhanced Earnings.Â Successfully represented husband before the Waukesha County Circuit Court and Court of Appeals in his claim for compensation for the wifeâ€™s acquisition of advanced educational degrees during the marriage. Husband awarded money for the value of the wifeâ€™s degrees obtained during the marriage; wife was assigned her student loans as non-marital property; court imputed six figure income to the wife, based upon the advanced degrees, which negated any child support the husband would owe her. In re the Marriage of Weiler v. Boerner, 280 Wis. 2d 519 (Ct. App. 2005).
Child Custody and Visitation
A grandparent, step-parent or other person who has maintained a relationship similar to a parent-child relationship with the child may petition the court for visitation if the childâ€™s parents have notice and the court determines that visitation is in the childâ€™s best interest. The specific circumstances that must be shown are very fact-dependent, so contact us if you have questions about proceeding.
Adoption
An adoption may be filed by a married couple, an unmarried adult, or a stepparent of the adoptee. A child is available for adoption only if both parents are deceased or their rights have been terminated. Additionally, the child must have resided with the petitioner for at least six months. In a stepparent adoption, the non-custodial parentâ€™s rights must have been terminated.
Paternity
Â for over 35 years. Guardianship
Private guardianships are governed by Chapter 54 of the Wisconsin Statutes. Alternatively, guardianships may also be entered under Chapter 48 of the Wisconsin Statutes, is for children under the jurisdiction of the court.

Spousal Suppo rt. Â Husband (client), after a 20 year marriage, was not opposed to a fair property division, but did not feel it was fair to have to pay spousal support.

Murder
Attempted Murder.Â Defendant was charged with firing a sawed off shotgun at the victimÂ from point blank range. The victim was shot in the leg and crippled. The issue in the case was identification. A close reading of the discovery suggested the existence of more police reports. A motion to produce resulted in the disclosure of several confidential informants and identification procedures, some of which excluded the defendant. Further, investigation of an important state witness revealed that she had just been charged in another county with stabbing an individual and had a lengthy prior record. When this information was ultimately assembled, it raised serious doubts about the accuracy of the identification and the guilt of the defendant.
Juvenile Crimes
Homicide
First Degree Intentional Homicide. Victimâ€™s throat was slashed on a street corner. He suffered a laceration of the left internal jugular vein and a partial laceration of the common carotid artery. The victim had walked out on the defendant, his girlfriend, at a tavern that evening and had identified the defendant as his assailant. Identification was the issue. An alibi defense was presented along with expert testimony relating to the effects of blood alcohol on perception, memory, and recall.
Restraining Order
Procedurally, the petitioner must file a petition with the court requesting specific relief. There is a 2-step procedure.Â At the time the petition is filed, if the court finds reasonable grounds (typically based on the partyâ€™s statements) that the respondent has engaged in or based on prior conduct could engage in domestic abuse or harassment, it will issue a temporary restraining order against the responded that would be in effect immediately. This temporary restraining order is in effect until a hearing on the request for an injunction.
