Misdemeanors
Karl Manke, the 77-year old Owosso, Michigan, barber under attack by Governor Whitmer’s administration for safely opening his barber shop and cutting hair, hired Kallman Legal Group as his legal counsel. The State brought three separate legal actions against Mr. Manke. First, the county prosecutor charged Karl with criminal misdemeanor violations for allegedly violating Governor Whitmer’s Executive Orders (EO). Second, the State health department (MDHHS) brought legal proceedings against Mr. Manke. Third, the State’s licensing department, LARA, brought licensing actions againt Mr. Manke’s licenses. All the EOs issued by the governor after April 30, 2020, however, were illegal and unlawful because the of the ruling of the Michigan Supreme Court on October 2, 2020.
Murder
Criminal punishment, depending on the offense and jurisdiction, may include the loss of liberty, government supervision (parole or probation), community service, fines, and other penalties. There are some archetypal crimes, such as murder, but the acts that are forbidden are not wholly consistent between different criminal codes, and even within a particular code lines may be blurred as civil infractions may give rise also to criminal consequences. Criminal law typically is enforced by the government, unlike the civil law, which may be enforced by private parties.
It can also be understood to regulate corporate contracts, hiring practices, and the manufacture and sales of consumer goods. Many countries have adopted civil codes that contain comprehensive statements of their commercial law. In the United States, commercial law is the province of both the United States Congress, under its power to regulate interstate commerce, and the states, under their police power. Efforts have been made to create a unified body of business law in the United States. The most successful of these attempts has resulted in the general adoption of the Uniform Commercial Code, which has been adopted in all 50 states (there can be slight variances to the code in each state).
Business law (sometimes known as commercial law) governs business and commercial transactions, business organizations (corporations, LLC’s, and partnerships), contracts, civil litigation, document preparation and review, employee/employer relations, wrongful discharge, and many other areas.
