Helping friends and family in their time of need is a fundamental Illinois value. But when a family member becomes sick or is seriously injured, and that member is no longer able to take care of his/her own affairs, then you may need to step in and take on a legal guardianship role. Often, guardianship and conservatorship remain as the best possible solutions for when a family member becomes mentally or physically incapacitated. Guardianship is also an essential legal tool for helping children who are not of legal age to make their own decisions.
Legal regulations and tax codes become more complex each year, and they make a world of difference in how people wisely provide for their families–both the present and in the future through estate planning and administration.
Wills
It is not a pleasant thing to think about, but there will be a time when you will pass away. Before that time comes, however, it is important to get your financial affairs in order by drafting a last will and testament. A well-drafted will can have several legal and financial advantages regarding your estate and how it will be distributed among your family and friends.
Trusts
Express trust in public and private. A public trust, also known as a charitable trust, is an express trust created for a charitable purpose. If an express trust is not a charitable trust, it is deemed to be a private trust. A private trust is an express trust created to benefit a few persons. This article discusses some aspects of public and private trusts.
Power of Attorney
Having a power of attorney (POA) document is a fundamental component of a well-rounded and strong Illinois estate plan. As a legal document, a power of attorney allows you to transfer authority of the management of your assets to a trusted person of your choice (agent). A POA can also be used to manage healthcare decisions too as part of your healthcare directives.
