Divorce

Child Support
Child support is money paid by one parent to the other to ensure that their child’s standard of living is not reduced because of a separation or divorce. Usually, a parent making more money will pay the parent making less money. Parents have an equal obligation to financially support their children, with child support typically paid to the primary custodial parent. Child support payments must be enough to cover the reasonable needs of each child, such as his or her education and health expenses. The court also has the power to require parents maintain health insurance for the child and even assume certain additional expenses. Everyone pledges to be a great parent and to do “what is best for the children.” However, things can start to change whenever money is involved. You can always pay more than required, but we need to make sure what is ordered is truly enough.
Child Custody and Visitation
The most emotionally agonizing and potentially expensive aspect for a parent going through divorce is child custody issues. If the parents cannot agree on their own, a Family Court judge is tasked with determining what is in your child/childrenâ€™s best interest. Even otherwise good parents can lose primary custody of their children in a contested custody battle. However, if both spouses are fit to parent and can set aside their differences, both can have a part in maintaining a loving and relevant relationship with their child/children. In the ideal situation, a divorce does not result in either one parent or the other. Instead, it is continuation of both loving parents, just in a different manner than prior to separation. It can be done, but it will be tough. You just have to constantly remind yourself that your children are paying a price for something they had no control over. Always do your best to ease what they are enduring. Perhaps by helping them adjust, you can also heal in your new life.

Spousal Support
Because money is always an issue in divorce, alimony is a big concern. However, alimony is not awarded in every case and is not used to punish adultery. Rather, the type and amount, if awarded, depending on a number of specific case factors. For example, if you are married for only a brief time, alimony is usually NOT indicated. In many cases, neither party is required to pay any alimony at all. After all, the purpose of alimony is to help get your spouse re-established and/or to maintain their current economic status.
Legal Separation
Before seeking a divorce, a person can obtain a legal separation by asking for a Decree of Separate Maintenance and Support. In order to file for divorce or separation in South Carolina, at least one (1) of the parties must have resided in South Carolina for more than one (1) year, or show that both spouses have lived in South Carolina for a minimum of three (3) months. During this initial filing, you will also need to determine if there are other immediate legal issues that need to be brought before the court, such as child custody, support, and visitation as well as temporary alimony. In a final divorce decree, all marital issues, including property division, child matters, and any other alimony requests will be resolved

DUI/DWI
I am reminded of a real case out of Charleston, South Carolina. It involved a young woman who was just starting her life as a Registered Nurse (RN). She had recently married and was beginning her nursing career helping others. After work one afternoon, she and several fellow nurses went out for a drink before heading home. She had only consumed two (2) alcoholic beverages and had a relatively low BAC level. While driving home, she was in a hurry and made the fateful decision to try to pass another car on a curve. As she began her pass, she struck another vehicle head-on and killed several people inside, including a child. She was also very seriously injured but survived the crash. Because she had a blood level of 0.07%, she was charged and plead guilty to felony DUI. She was sentenced to ten (10) years in prison. Her life, while not completely over, was substantially put on hold. Her nursing career was over. Her marriage may not last for the ten years she will be away. All of this pain for a moment of bad judgement. She was a nice girl from a good family. She had never been in any legal trouble before in her life. Now, she will spend years in a women’s prison. She could not believe it. Her husband and family could not believe it either. But it happened to her. And it can happen to anybody. Even you.

Being charged with any DUI offense is always serious, and a conviction will result in a permanent criminal record. But, a DUI is a misdemeanor and usually only requires payment of fines, ADSAP, SR-22 insurance, and loss of driving privileges for six (6) months, subject to a provisional license. However, if you are drinking while driving and someone is seriously injured or killed, you can be charged with a felony DUI that could result in years of time in state prison, up to 25 years. No one ever expects something really bad to happen. It is all too possible for an average, law-abiding citizen to find themselves in serious legal trouble from just one bad mistake in judgement. This is why you should never get behind the wheel if you have been drinking. A DUI can be the least of your worries if you become in an accident on the way home, even if someone else hits you. Even if it is a passenger in your car, you could be charged with felony DUI if anyone is seriously injured as a result of an alcohol related accident.
