DUI/DWI
Driving under the influence (DUI) of alcohol, drugs, or other intoxicating substances is a criminal offense under Georgia Code § 40-6-391. Drunk driving laws were passed largely to discourage people from operating motor vehicles after drinking alcoholic beverages in hopes of possibly reducing and preventing the number of injuries resulting from accidents caused by intoxicated drivers.
Wrongful Death
When a person is killed in an accident, the unexpected death creates not only profound grief for family members but also many dramatic changes the lives of spouses, children, or other individuals who were financially dependent on the deceased. The beneficiaries of people killed as the result of the negligence of another party may obtain compensation through wrongful death lawsuits. Estate executors or administrators may, similarly, file survivor actions.

Hit and Run
Georgia state law requires anybody involved in a motor vehicle accident to stop and exchange certain types of personal information with all other people involved in the wreck. New Appleman on Insurance Law Library Edition is a book written by scholars and practitioners of insurance law. The chapter available through this link “discusses the contractual, equitable, and statutory subrogation rights that are available to insurers after they have paid a policyholder’s claim for damages that were caused by a third-party tortfeasor.” The authors write, “Statutory subrogation rights frequently arise in connection with government-mandated benefits and insurance such as workers compensation, uninsured/underinsured motorist coverage, Medicare/Medicaid, and the federal Employee Retirement Security Act of 1974 (ERISA).”
While some accidents are mere fender-benders involving minimal property damage, many other crashes result in far more serious property damage and even bodily injury. When a collision is the direct result of another party’s negligence, injured victims may be entitled to compensation for their medical expenses, lost wages, and pain and suffering.
Money that is awarded to a person injured by another party’s negligence is often referred to as damages in the context of tort law. Compensatory damages in personal injury cases are intended to make the victim whole again by covering the costs of caring for the harm caused.
Medical Malpractice
When any kind of a mistake is made during a medical procedure, the error can have a profound, possibly life-altering impact on the life of a victim. When a health care professional fails to competently perform his or her medical duties, it is referred to as medical malpractice—a highly complex area of law that involves plaintiffs needing to satisfy certain special requirements.
