Criminal Defense
After a defendant either pleads guilty too or is found guilty of a criminal offense in New Jersey the Judge must impose a sentence. If the criminal charge which the defendant needs to be sentenced on is a felony offense, the Judge must order what is known as a Pre-Sentence Report. This report helps the Judge understand who the defendant is and this will allow for him to impose a sentence which he sees fit. On the other hand, if the defendant is being sentenced to a disorderly persons offense, the defendant will be sentenced on the spot without the benefit of a pre-sentence report. At this point the Judge will be imposing a sentence based on the underline facts of the case and the argument your defense attorneyÂ puts-forthÂ on your behalf. The Law Offices of Jonathan F.
